My band has a hole! HELP

Ok, my story is very long and I won't go into all the details or this will be too long. I was banded July 1, 2003. That October I moved to Pennsylvania. I had major complications after surgery and my original Dr. thought I had a hole because I could not get the proper restriction. The did x-ray's but could not see a hole. I moved bac to PA like I said and started seeing a Dr. here. Who discovered I did in fact have a hole but that it was a slow leak and that is why they could not see it before. My Dr. believes the hole was there from day #1. My husband and I were going to try to get pregnant so I told him I would hold off for awhile. Well, now my question is does my surgeon who put in my band have any responsibility to fix this? Do you think I need to talk to an attorney? Please give me any advise you may have. I have lots of other issues with my suregery as well. Please feel free to email me at Robben1@msn.com

Thanks

Robin

Robin, is Ionamed the manufacturer of your band? If so I would email Don Mills or one of the Ionamed reps concerning the matter. Also, Vera just had to have her band replaced due to a similar problem. You might want to find out what route she took for starters.

Tracie, just click on "New Thread" on the main page of the section where you want to start the thread. If it's on general banding issues, for example, it would be in General Lap-Band Discussion.

Robin, I agree that contacting the manufacturer of your band is the first thing you should do. Who if anyone bears responsibility for that hole is a matter to be determined: was the band defective from the start? Or did the surgeon do something to damage it during surgery?

Good luck and please let us know how events unfold. I hope everything turns out well!!

Well, now my question is does my surgeon who put in my band have any responsibility to fix this?

Yes!

My hole was in the tubing. Dr. Sanchez replaced my band after an atempt to fix the tubing, but that didn't work. The manufacture of the band had to pay for the replacement and surgery costs.

How could your doctor prove that the hole was caused by the surgeon?

Time is your enemy! Get your band fixed ASAP

I have 2 children and can understand your situation.

Feel free to PM me.
