Linear❤️ 3 Posted January 13, 2018 Hi all! New to this site and having surgery Jan 16.... in 3 days! I need to apply for ca statue disability... my surgeon automatically gives 6 weeks off work. I’m not telling my employer I’m having gastric sleeve - they are know I’m “having surgery to address health issues”. When I apply for ca state short term disability and my surgeon fills out their portion, will my employer see that info or receive any info of my surgery type? Thanks in advance to all for answering! NegreteLove 52 Posted January 13, 2018 No your employer will not receive any medical info. I work HR in California and deal with state disability papers all the time.Sent from my SM-J327T1 using BariatricPal mobile app
winknsmile 8 Posted January 13, 2018 I believe it is illegal to share any medical info per the HiPPA laws. Short term disability is with a company separate from your work company. That's how it was when I was an HR manager. The insurance company will be the one that receives your information. You should have a number for them. Also, if you have to show your HR manager they are supposed to keep that information confidential. Good Luck!
Losebig 508 Posted January 13, 2018 Unless you sign a release they cannot share any specific medical info. I've had employees have similar things and all we see is they have a medical reason that requires the time. We aren't supposed to even really ask why. The insurance company does get all the info, but is bound by HIPPA rules so can't share it
