Thanks for your help :-) My husband used sick leave he had and that's why he filed fmla. That way it wasn't held against him when he took off. If your husband can schedule vacation for your surgery and it not be held against him then I would say he wouldn't need to file for fmla protection. Share this post Link to post Share on other sites

nickyvolzz 17 Posted July 26, 2012 Okay I'll have him file then. His work is really a bunch of d**** so he doesn't even get sick leave but atleast he gets vacation. Yeah it is better to be safe than sorry though so I'll have him do the paper work.
