If there was a Class Action Lawsuit against the band....

Recommended Posts

I use to love my band and probably still do. But I have gone through a lot with it. I suppose we failed each other, but it failed me first. I only lost 45 lbs in 4 years and I really tried. After all of the pain, stomach bloat, and reflux that was horrible I went through....sign me up too. I cried all the way home from the Dr. yesterday because it's not working any more and I've known that for a while now, but just to hear it again and the fact that my insurance may not cover the sleeve but will cover the bypass really saddened me.

With ANY product u put on the market where u do indeed make money ( they didn't design the band to help us , if it wasn't profitable , there wouldn't be a band) u can be held liable for the product not being what you say it is when you sell ....... If I had half the problems out of any car that I have bought. .......... I would of already set fire to the dealership. Lol. Wayyyyyyyy to much money and time wasted on the lap band while the industry was making money hand over fist. Yes ,,,,,,,,, yes I would join a joint venture action against them. That's what it might take to keep people from being fooled by the dr's into putting this in there body, just to find out its a horse **** of a deal. ( do I sound angry ,,,??? I feel like I'm coming off angry. Lol)

I first thought, no, I wouldn't. I knew there were no guarantees going into this. But on 2nd thought: Yes! You betcha. I'd do anything for a buck (as I'm sure most people would if they had a strong case).

In 2001, my mom had a heart attack at the same time she was taking Vioxx. A few yrs later, it was found that Vioxx caused heart problems. there was no proof that it's what caused it but she joined the lawsuit nonetheless. After about 18 mths, she won $170,000 in 3 payments. I'm sure Merck Pharmaceutcals lost alot of money on that drug

Yes yes yes! Even when I set an appointment for my sleeve consultation the first person they had me meet with was also a nurse who worked for lap band. Tried to convince me to keep it to get their numbers up despite my years of misery. I told her no way in hell! It was obvious they didn't care about my health, only their bottom line!

Class action lawsuits are different for consumers versus regular lawsuits. You usually just have to sign up for it and then after a while you get a check in the mail if you won the lawsuit. You are not out any money and don't have to do anything but fill out a form. At least that's my experience.

I paid out if pocket for my band. It was over 11k in hospital and surgeon fees to have it placed. I worked hard to get my band, and have paid dearly with both my mental and physical health since it was placed. I was lead to believe going in that it was permanent, that I would likely never need another invasive procedure (aside from fills) I will now have to have a removal. Do I take responsibility for my decision to have it done YES! I've lived with it and kicked myself for not having the willpower on my own to not need it... But if I had a chance to recoup the money I spent or time I spent in misery... Yep I'd sign up for that! And will... I'm sure it's coming!

Exactly. I just got my check from Skechers last week for $35 for the false claims they make with their Shape-Ups shoes :)

I have mixed feelings about the band. I had it for just over 7 years, and lost and maintained a 50 pound weight loss. I never got to my goal weight, but that was more my fault than the bands. However, I had 3 port revisions, and finally had a slip in April 2013 and had to have it removed. With the band, I had some real problems, but I'm also grateful for that 50 pound loss. I'm just starting the process to get a sleeve. My doctor wanted me to wait 6 months till the irritation/inflammation from the band settled down.

So the bottom line is that I would probably join a class action suit against the band. I had a lot of co-pays, and a lot of time missed from work. I also had nasty acid reflux and a terrible time taking my meds cause of swallowing difficulty.

I would take part in a class action suit! This has been nothing but a let down and a device that should have been tested more before FDA approval. The stomach pain and throwing up has been horrible even with no saline in the band. Hell yes I'd sue!!!! My band has had success with weight loss of 100lbs but its not worth the problems that came with it.

I want in on a Class Action Lawsuit!!!

I have been seeking an Attorney for 1 1/2 years and cannot find one to help.

I have all of my documentation along with pictures. Here's My Story.

There are thousands of people like me that have the same medical problems that I have, problems that will NEVER go away, side effects that we were NEVER warned about. We all had Lap Band surgery to lose weight but what we received instead is a medical nightmare that changed our lives forever.

Lap Band installed 07, vomiting and pain began immediately thought it was normal. Started going to Doctors and hospitals nothing found, then the diarrhea started, again Doctors and hospitals, colonoscopy and endoscopy 01/2012 (date of discovery) found lap band had eroded into my stomach. Lap Band removed 01/2012, very ill, still pain, vomiting and diarrhea. Constant vomiting caused a hernia so another surgery to repair hernia 11/2012. Still pain, vomiting diarrhea continually going to Doctors and hospitals, specialist does another endoscopy 07/08/2013 and finds major problems where my stomach was repaired, sends me to a surgeon immediately because he was so worried, saw surgeon within two days on 07/10/2013. Surgeon did his own endoscopy 07/22/2013, told me the lap band did a number on my stomach and he could not do the repair said I needed to see him in his office 07/26/2013 so he can go over alternatives with me. I am still vomiting and have diarrhea more times a day than I can count and the pain is severe. My Surgeon is a Bariatric Specialist and he no longer does Lap Band Surgery because of the damage Lap Bands do. He would make a great witness on my behalf.

I go nowhere except to Doctors and Hospitals, when I do I take a bag that consists of trash bags, paper towels, baby wipes, Water and a change of clothes. I vomit and have blasting diarrhea EVERY TIME I eat anything. I am single but cannot date; my boyfriend broke up with me because he could no longer handle my illness. My life has changed so much. Sometimes I crawl from the bed to the toilet several times a day, sometimes I make it sometimes not. I have vomited and had diarrhea while in the car and in the presents of others. A couple of months ago I was so sick that I was on a gurney at the hospital the vomiting and diarrhea would not stop and a hospital employee made the comment "disgusting she crapped all over herself". The pain is like having hundreds of hot knives cutting into my stomach. I have so many scars it is embarrassing, I will never be able to take my clothes off in front of anyone again. This is a small list of what I have been through and there are others just like me and some are worse like losing their eye sight. I have all of my documentation along with pictures to back up my story.

I feel the Doctor was negligent because he never warned me of these possible side effects and the danger. The Lap Band was defective because it eroded into my stomach.

My life will never be the same and my health will never be restored.

I may need surgery to completly replace my stomach and or a feeding tube.

I have lost 20+ pounds after the Lap Band was removed because of vomiting and diarrhea, not because of the Lap Band. I also got an infection while in the hospital.

I truly believe it is just a matter of time before that commercial hits the tv. I have said it for awhile now and I don't blame anyone for signing up for it. Good luck to all when it happens! :)

Day 1 of pre-op liquid diet (3 weeks) and I'm having a hard time already. I feel hungry and just want to eat. I got the protein and supplements recommend by my program and having a hard time getting 1 down. My doctor / nutritionist has me on the following:
1 protein shake (bariatric advantage chocolate) with 8 oz of fat free milk 1 snack = 1 unjury protein shake (root beer) 1 protein shake (bariatric advantage orange cream) 1 snack = 1 unjury protein bar 1 protein shake (bariatric advantace orange cream or chocolate) 1 snack = 1 unjury protein soup (chicken) 3 servings of sugar free jello and popsicles throughout the day. 64 oz of water (I have flavor packets). Hot tea and coffee with splenda has been approved as well. Does anyone recommend anything for the next 3 weeks?

All I can tell you is that for me, it got easier after the first week. The hunger pains got less intense and I kind of got used to it and gave up torturing myself by thinking about food. But if you can, get anything tempting out of the house and avoid being around people who are eating. I sent my kids to my parents' house for two weeks so I wouldn't have to prepare meals I couldn't eat. After surgery, the hunger was totally gone.
