Why Are There Always Hoops To Jump Through?!

Recommended Posts

So I do everything right at work and apply for my short term disability through their contracted peeps and I get a letter denying me FMLA as I haven't been there for a year.

I must add that despite this letter I'm moving forward.

This can only mean they don't have to hold my job. According to our policy (I work for government) I qualify for STD after six months. I've surpassed that. So. I really am not reading too much Into this other than its yet another thorn in my side that isn't needed. :(. I'm trying to battle this bronchitis before surgery and I certainly don't want to be running around figuring all this out. I have calls in to both the contracted person as well as HR. HR is notorious for not retuning calls. I'm not though. I'll keep calling ;)

Pisses me off. :(

Hi!

I work in HR and it is a Federal Requirement/Law that you have to be employed by that specific employer for 12 months and have worked 1250 hours to be eligible for the FMLA portion of a leave. SInce your company offers you 6 weeks of STD, normally, you should be job protected while on STD. If you moved to LTD then they can probably replace you if there was a business need.

Additionally, if you reach your 1 year mark anytime during your STD, you then become eligible for FMLA. If you reached your 1 year mark 2 months after your surgery, you then become eligible and could take it if you were still having recovery needs and issues requiring you not to work.

Good luck! I know the rules and red tape are such a PIA!

Thank you. I think I'm okay. Not too worried anyway. I'm doing this regardless. Talked to HR and they don't seem to have any issues. Whatever.

LOVE this forum. LOVE the people and all the support!

I was trying to understand what you were asking so I could OFFER HELP. I'm an HR person and could maybe answer questions or give advice or help you manage your STD claim process.

However, it sounds as though you don't need help and just needed to vent. Sorry I asked.

You didn't sound very supportive. My bad. I get really sick of reading people pick apart people's posts and your comment sounded like one of them. My apologies if I misread or mistook that. I do appreciate you offering some sort of understanding.

Thank you ladies - I do feel better about this- still waiting on the STD approval and it should be fine but if you're anything like me- I like all my ducks in a row so I can not worry. :(. Perhaps I'm overreacting.

Sometimes these forums I read make my not want to post :(. Oh well..... I still learn a lot from reading too :)

It's tough to gauge tone of "voice" with only typed words. If you have questions, it seems like have several HR people in the forums willing to help. I'm sorry your HR person isn't responsive; I can see how that would be really frustrating.

Good luck to you.

Day 1 of pre-op liquid diet (3 weeks) and I'm having a hard time already. I feel hungry and just want to eat. I got the protein and supplements recommend by my program and having a hard time getting 1 down. My doctor / nutritionist has me on the following:
1 protein shake (bariatric advantage chocolate) with 8 oz of fat free milk 1 snack = 1 unjury protein shake (root beer) 1 protein shake (bariatric advantage orange cream) 1 snack = 1 unjury protein bar 1 protein shake (bariatric advantace orange cream or chocolate) 1 snack = 1 unjury protein soup (chicken) 3 servings of sugar free jello and popsicles throughout the day. 64 oz of water (I have flavor packets). Hot tea and coffee with splenda has been approved as well. Does anyone recommend anything for the next 3 weeks?

All I can tell you is that for me, it got easier after the first week. The hunger pains got less intense and I kind of got used to it and gave up torturing myself by thinking about food. But if you can, get anything tempting out of the house and avoid being around people who are eating. I sent my kids to my parents' house for two weeks so I wouldn't have to prepare meals I couldn't eat. After surgery, the hunger was totally gone.

I have my final approval from my insurance, only thing holding up things is one last x-ray needed, which I have scheduled for the fourth of next month, which is my birthday.
