Anyone Else Not Qualify For Fmla?

I didnt know you had to be employed 12 month or work 1250 hours. I have worked over 1250 hours but was a temp for 5-6 months of that before going perm I am using all 7 of my vacation days for my time off. I do have another 5 days sick time if i feel i cant come back.

But i am now worried that my job wont be safe if I have any complications.

Anyone else habe some insight?

Are you unionized? Im a nurse and i too was scared but my supervisor said ," whoa were not that evil to just fire you because ur sick! Take care of yourself first". Im on disability without being on FMLA. Ive only been working for 7 months. Uve been there awhile so maybe theyll accommodate u. Good luck!

I had my surgery after being at my job for 8 months and didnt qualify for FMLA. No, your job isnt protected but most employers arent that cruel. I used all my sick leave for the year (2012) and some vacation for mine. I was out 3 weeks...wanted to come back to work after 1 week but dr wouldnt let me. I got lucky since we get one sick day a month and start with two weeks vacation. I would suggest talking to them , I am sure you will be fine but just in case.

When you add your temp time and perm time do you have 12 months of service? I would think your temp time counts....maybe not.

In most cases the time worked has to be on a "perm" basis...and "temp" time won't count towards the limits. I hope you have no complications, and that your employer values your contribution to their team!! Best of luck!

does your company offer Short Term Disability? I'd check there - as this way your job is safe and you get paid (my company pays 100% up to 3 months - then you'd have to switch to Long Term Disasbility at 60% salary)

For some reason I think you have to have the insurance to qualify for the short term disability. I do not carry any of our insurace since my husband has me on his. (his insurance is better)

Its long term disability that you pay for short term is automatic

Check on your companies website where benefits are posted or talk to someone in hr.

I am going to talk to HR before surgery and see what are my options in case there are any complications.

Fmla is a federal law, which means it applies to every single state. There are, however, rules that apply to Fmla to qualify. And individual states have their own laws and rules regarding disability etc.

Best bet is to do what you said and talk to HR! Good luck! :)

I didn't qualify for FMLA but my job offered "medical leave". I was approved to take 6 weeks off where they protected my job. It was only allowed once your first year but then FMLA kicks in after that. I even received short term disability benefits. Check with HR and se if you have any other options.

Most of the time, I feel like people are okay to go back to work in a week or two. I know some people have harder recoveries than others or complications.I was back doing work and college a week later. But the catch is I'm not on my feet all day. If your job isn't labor-intensive, I bet you can come back with no problem. But it is so individual. I am sure they would work it out for you since they value you as an employee. I mean they liked you enough to make you a permanent team member after being temporary :-). I think it's smart of you to talk to your HR. I am sure you will be fine but it's smart to check out your options. I hope you hear good news!

I am planning on being back to work 8 days after surgery. I have a cubicle job. I am sure it will be exhausting at first and I plan on letting my boss know that it will take a week or two after I am backfor me to be in full swing fast pace again.

I was just hoping that the fmla covered me in the event I have any complications that could keep me from returning. My department doesnt handle someone being out more than a day or two before things get behind. In fact when I put jn for my 7 vacations days my boss wasnt going to approve it but did when I told her it was for surgery.

Makes me mad that they havent hired enough people in our department so that we can all take our vacation/personal time without us all having to work so much overtime. I almost bet my boss will ask me to work every weekend after coming back. not sure how that will go over.

I work in human resources and know way more about FMLA than I ever wanted to. If you have been there a year INCLUDING your time as a temp, then you qualify. A lot of HR people are confused about this. If your total time with this company--even though you were a temp--is 12 months or more let me know and I will find the information that you need to take to HR to help them understand that you do qualify.

      Hi everyone! I’m brand new here. I just went through all my pre-op requirements per my insurance company and now everything has been submitted and I’m just waiting for final approval and my surgery date. I’ve been doing research, watching YouTube videos, TikTok’s, ect.. trying to prepare my mind and what to expect so I’ll be ready for the surgery. I was so sure and so set and so ready and excited. However, now that I’ve done everything & it’s almost here, I am sooooooo scared! I know why I want it bc I’ve tried everything and I just don’t feel like I can lose weight by myself. I’m tired of being overweight my entire life. I’m miserable, but I keep psyching myself out afraid of GERD bc I know how that can be and I don’t want to have to get a bypass after already gaining the courage to even get VSG. I’m scared of complications like I’mgoing to regret doing it and be depressed that I didn’t just be more disciplined and try again to lose the weight on my own even sitting here typing this knowing in my mind i just can’t and don’t possess the discipline. I’m also afraid I won’t be able to handle the restrictions of the sleeve. What do I eat? I don’t know how to eat healthy really and don’t enjoy healthy food. I don’t know how to do this! I feel so defeated!Someone tell me they felt anything similar to this or am I not ready? I thought I was. I am so tired of being sick and tired and so tired of myself and so tired of being stuck and stuck in this body and somebody different on the outside from what I feel inside. I just want to ball up and cry.

      The 14th was my day. I am home and recovery is going pretty smooth. They even let me walk out of the hospital. Picture of me in recovery curtesy of my boyfriend lol.

        Neat you have a pic of this day! I was sooo happy to get my surgery. It was well worth it! And I'm not even near my goal. I had surgery Dec. 2!
