Help Appealing Experimental Investigational Denial

I received a denial letter from Highmark BC/BS on March 25th . I was denied because they deem the band procedure as experimental/investigational. They contend that RNY is more effective and has better long term results…yadda, yadda. It’s nothing that we haven’t heard on this site a million times before.

Since my insurance company is self insured, I have been fighting with my HR department, to no avail, to get the policy changed. What is so outrageous to me, is the fact that if I lived in a different state (5 miles from my home) I would have Cigna and the policy would cover it. I happen to live in Mass and therefore my company offers Highmark BC/BS to people in MA. Highmark is a Pennsylvania based insurer. My company, Alcoa, is headquartered in PA. So, the bottom line is, if I lived in CT right now I would be banded and all this denial BS would be behind me.

So, now that I’ve rambled in frustration…..let me get to the point. Does anyone have documentation or anything that supports the use of Banding over RNY? I know that this is the type of information that will help me with the appeal. Any info would be terrific.

Hi Gina - just wanted to let you know that I also was denied for investigational purposes - by Anthem Blue Cross/Shield of CT. They are very known for doing that the first time out.......I hired a lawyer for under $500 and he did an appeal in about 3 weeks - and I was approved! So all is not lost. The lawyer that helped me was steve kalman and he has the band himself. He doesn't live near me - lives in PA, I think - but I learned of him from another bandster who had been in my situation. I emailed him my info then we went back and forth - he decided if he had a chance or not...then got on it! I'm thrilled - anyway - his email/website is bandedlawyer.com.............good luck!

I don't get it. I have Anthem BC/BS and was approved in 3 weeks. I just figured that if you had BC/BS and it approves some people, it would approve everyone. But I guess it is up to your employer as to whether they allow the band or not. It sucks. Hope you have a successful appeal.

      Day 1 of pre-op liquid diet (3 weeks) and I'm having a hard time already. I feel hungry and just want to eat. I got the protein and supplements recommend by my program and having a hard time getting 1 down. My doctor / nutritionist has me on the following:
      1 protein shake (bariatric advantage chocolate) with 8 oz of fat free milk 1 snack = 1 unjury protein shake (root beer) 1 protein shake (bariatric advantage orange cream) 1 snack = 1 unjury protein bar 1 protein shake (bariatric advantace orange cream or chocolate) 1 snack = 1 unjury protein soup (chicken) 3 servings of sugar free jello and popsicles throughout the day. 64 oz of water (I have flavor packets). Hot tea and coffee with splenda has been approved as well. Does anyone recommend anything for the next 3 weeks?

        All I can tell you is that for me, it got easier after the first week. The hunger pains got less intense and I kind of got used to it and gave up torturing myself by thinking about food. But if you can, get anything tempting out of the house and avoid being around people who are eating. I sent my kids to my parents' house for two weeks so I wouldn't have to prepare meals I couldn't eat. After surgery, the hunger was totally gone.

      I have my final approval from my insurance, only thing holding up things is one last x-ray needed, which I have scheduled for the fourth of next month, which is my birthday.

      Woohoo! I have 7 more days till surgery, So far I am already down a total of 20lbs since I started this journey.
