Anyone Else Feel Like A Class Action Suit Against These Doctors?

The lap band did not work for me at all. The doctor kept filling and it kept leaking. I am tired of hearing his advertisement about "I'll change your relationship with food". What a load of crap. Every time I hear it I want to file a class action suit for malpractice or false advertising or something. Anyone else in my boat?

it must have been faulty. how come he didnt replace it for you? perhaps letting him know that you are prepared to take it further may move hiim to do something.

I am so sorry you have had a disappointing experience with he band. But I also agree that you should to talk to your about replacing the obviously faulty band. I don't understand why he hasn't suggested this already. I would try contacting the manufacturer, because if it is a fault with the actual band and not placement or the surgery, they will be the ones held responsible. Good luck and talk to your Dr.

Everyone takes the risk of a complication like a leak. If you cant afford to get it replaced I am really sorry for you but Im not sure its a reason for a lawsuit unless there is some reason you think your doctor is not doing his job right.

I'm very sorry you're going through this. As others have asked, are you getting the band replaced? Has the doctor suggested it?

Unless you had yours done in Mexico or some other foreign country, we're told repeatedly from the very first seminar the band doesn't guarantee weight loss. It's not a magic bullet it's a tool and we must still do the work. In your case, your tool is broken and needs to be replaced. Even if your band wasn't broke and you didn't lose weight, I'm afraid you still couldn't have a successful lawsuit. They are very clear the band doesn't work for everyone, it's a risk we all take.

The only way I can see you having a successful lawsuit is if your doctor is negligent, such as knowing there is a definite leak but refusing to replace/fix it. (even that is done at your cost.

Send a registered letter to the manufacturer and they will pay for the faulty lapband and your doctor will probably loose his/her ability to use their bands.

When I had my lapband I was told by a surgeon that the lapband company was extremely careful to make sure there was no bad situations.

Otherwise get a lawyer

      Day 1 of pre-op liquid diet (3 weeks) and I'm having a hard time already. I feel hungry and just want to eat. I got the protein and supplements recommend by my program and having a hard time getting 1 down. My doctor / nutritionist has me on the following:
      1 protein shake (bariatric advantage chocolate) with 8 oz of fat free milk 1 snack = 1 unjury protein shake (root beer) 1 protein shake (bariatric advantage orange cream) 1 snack = 1 unjury protein bar 1 protein shake (bariatric advantace orange cream or chocolate) 1 snack = 1 unjury protein soup (chicken) 3 servings of sugar free jello and popsicles throughout the day. 64 oz of water (I have flavor packets). Hot tea and coffee with splenda has been approved as well. Does anyone recommend anything for the next 3 weeks?

        All I can tell you is that for me, it got easier after the first week. The hunger pains got less intense and I kind of got used to it and gave up torturing myself by thinking about food. But if you can, get anything tempting out of the house and avoid being around people who are eating. I sent my kids to my parents' house for two weeks so I wouldn't have to prepare meals I couldn't eat. After surgery, the hunger was totally gone.

      I have my final approval from my insurance, only thing holding up things is one last x-ray needed, which I have scheduled for the fourth of next month, which is my birthday.
