Michele Reed Stelly 1 Posted February 8, 2012 My name is Michele and I live in Texas City, Texas. I was banded 2 yrs. ago by Dr. Duc Vuong. I was a full pay patient because my insurance would not pay. In his contract that I signed he has agreed to free fills for life as long as I go to him. Well guess what, he has uped and moved to Illinois. Now if I want a fill I have to pay $175. to become a new patient with another Dr. and $200 for any fills I get. Would y'all consider this a breach of contract? I have read the contract 5 times and there is absolutley no mention of another Dr. in the area honoring his free fills for life in the case he should move. 1 vdewberry reacted to this
DELETE THIS ACCOUNT! 12,703 Posted February 8, 2012 Unfortunately unless there's something specifically stating a doctor will do the fills in the event he moves, he's not in breach of contract. If you took him to court, all he'd have to say is "well I'd be happy to fill her for free, she just has to come to my office in Illinois" I'm very sorry. That absolutely sucks. Did you contact him and ask him if there are any alternatives? I'd even consider getting with other band patients of his and confronting him together. It's worth a try! Michele Reed Stelly 1 Posted February 8, 2012 I've been trying to locate some of his other patients but have been unable to.
DELETE THIS ACCOUNT! 12,703 Posted February 8, 2012 Maybe go to a local Lap-Band support meeting or two? You might be able to find some there. Also, put his last name in the search bar at the top of this page. Two pages of topics on him come up, including a lawsuit against him. I'd definitely have a look! shy2012 43 Posted February 9, 2012 If you go to the top and click on Surgeons and put his name in, when you get to his profile their is a link that says patients and it will show you all the patients he has that are also member of LBT. I hope this helps.
kll724 3,055 Posted February 9, 2012 Good luck in your search, but I don't think that it is breach of contract, as the op said, he will probably fill you for free if you go to Ill. Sorry, Karen
