Why I'm considering a lawsuit...

Only a money grubbing lawyer who has no interest in your success would take the case. It sounds like you don't even really have a case. Nothing went wrong from what I read in your OP.

I am a lawyer who does some plaintiffs med mal work. I can tell you that there is no way that I would take your case on a contogency or for a fee. The primary problem that I see is that you have not followed your doctor's instructions by not getting fills. In my opinion you would have no chance to win.

Find the money for fills and odds are the band will start working for you. Hell, I find that the money that I am saving in food more than offsets the cost of fills.

I go to Tijuna anve my fill it cost $100.00 , They pick me up and drop me by my car. Very nice Dr.

This is so true!!!! Good point!!

One of the earlier posters on this thread suggested that the thread starter rlynn, posted a scam! Maybe but either way, we have to assume that since rlynn has never replied, we must have chewed her up and spit her out enough that she is likely not reading these any more. My hope is that we planted a seed of hope.

Today is my 6 month bandiversary and I am so happy still that I made this decision. I am getting a hold on my food issues, and I am caring less and less about food. It is true that it is not a picnic all the time, but I have learned so much. Here is to the next 6 months. My goal is to be at goal by September..... Here goes............ Hugs........

You have to give the band time. With only 1 fill under your belt, of course youre not going to loose a lot of weight. I (like a lot of others) had to have several fills before I was able to tell a big difference. You also have to believe in yourself which by your post, and what you have told your sister, you don't believe in yourself?

Why would you even consider legal action if you aren't willing to do your part and continue with your fills? I understand that the fills are pretty expensive I think at my doctors office it's like 100 bucks a fill. Cant you just give up something when you know you need a fill and spend the money on that instead?

      Day 1 of pre-op liquid diet (3 weeks) and I'm having a hard time already. I feel hungry and just want to eat. I got the protein and supplements recommend by my program and having a hard time getting 1 down. My doctor / nutritionist has me on the following:
      1 protein shake (bariatric advantage chocolate) with 8 oz of fat free milk 1 snack = 1 unjury protein shake (root beer) 1 protein shake (bariatric advantage orange cream) 1 snack = 1 unjury protein bar 1 protein shake (bariatric advantace orange cream or chocolate) 1 snack = 1 unjury protein soup (chicken) 3 servings of sugar free jello and popsicles throughout the day. 64 oz of water (I have flavor packets). Hot tea and coffee with splenda has been approved as well. Does anyone recommend anything for the next 3 weeks?

        All I can tell you is that for me, it got easier after the first week. The hunger pains got less intense and I kind of got used to it and gave up torturing myself by thinking about food. But if you can, get anything tempting out of the house and avoid being around people who are eating. I sent my kids to my parents' house for two weeks so I wouldn't have to prepare meals I couldn't eat. After surgery, the hunger was totally gone.

      I have my final approval from my insurance, only thing holding up things is one last x-ray needed, which I have scheduled for the fourth of next month, which is my birthday.
