Since I started this process, I have been seeing my doc for various things on a monthly basis (just had visit number 3). The nurse at the band seminar advised this because she said that the ins might pull this stunt. Coincidentally, I've really needed to see the doc...had lots of sinus infection problems. Anyway, I always make sure that we discuss my weight and what I'm doing about it. I'm also keeping a food journal. Sure enough, my ins wants to see 6 months of dieting with my doc's supervision. So, I'm looking to have it done after Jan. Bummer. She hasn't written a letter since their denial. We're waiting for my 6 months to be completed. To date, I've lost some...gained some. Just like normal.

Let me start by saying....I AM NOT A LAWYER. You must do what you think is right. However, remember there is a statute of limitations on such actions...from the time you knew or when it happened. Since you only discovered it recently and had no way of knowing before...that starts your time period. I would have to have more info. Depends on if it was the kind that was suppose to dissolve...if so, why didn't it. Maybe a suit against the manufacturer of the suture? If it was suppose to dissolve, your doc probably expected that it would dissolve...so he couldn't predict what would happen either. Either way, if you are going to do something, you should get on the ball. If you decide to not take action, so be it. It's up to you. And as far as legal fees, most personal injury attorneys take cases on a contingency basis. In other words, if you don't get paid...they don't get paid.

I just completed a research project on fat discrimination. I've been treated the same way. Of course, in nursing, they don't care if you weigh 1000 pounds, just as long as you'll come to work. However, I know that it will matter when I try to get a job as an attorney. Some states do specifically state that fat discrimination is against the law. California has some laws and Michigan has some too. Other states rely on laws that protect other disabilities with the ADA(Americans with Disabilities Act). I am very passionate about this. I may end up serving as an advocate for our cause. Who knows? Still in school. -

I had the same "moment". Boy, was I in denial?! I thought, "I'm going to have to wait in the waiting room with all of those fat people. They're going to take one look at me and tell me I don't belong." HA HA HA!! You know, they acted like I belonged there...the nerve of them. And then I realized, I DO belong there. My bmi is 40. I'm only 32 and have arthritis, depression, and oh yeah, pee on myself occasionally. Here were my excuses for those problems in this order... arthritis-I'm getting older. Depression-Everybody is a little sad sometimes (although, mine was crippling) and peeing on myself...weak bladder-had 2 babies. Then I realized...I'm morbidly obese. I saw on a recent post where somebody said that an "ignorant doctor said I was obese." Well, my doctor is NOT ignorant...she tells the truth. That's what I needed. I'm not overweight, fat, obese-----I'm morbidly obese. There..I said it. -

I haven't been banded yet...jumping through insurance hoops. Denied-want to see "6 months dr supervised diet" That should put me after the first of the year. I can't wait!!! -
Docs always blame the anesthesia. That is why anesthesiologists have one of the highest malpractice insurance rates. (OBs are up there too). I'm not banded yet and won't be until after the first of the year, due to insurance delays. I'm planning on being banded here in Nashville. However, I've told my husband to post here if anything happens to me. In an effort to get the info out. I'm reasonably healthy and have faith that God will see me through. I'm not sure what the recourse is for medical malpractice in Mexico. Back to the point, I'm very sorry about your friend. I'll keep you and yours in my prayers.

Update. Ins wants 6 months doctor supervised diet. Well, I've been seeing the doc for various things the last three months...so only 3 more to go. She's been weighing me...discussing my diet and exercise etc. Hope that works. Looks like I'll be banded after the first of the year. It's ok. My family doesn't know that I'm having it done. My DH does...but that's it. So, my family will just assume that I'm losing my January weight (my yearly resolution that has gotten me up to 270 pounds)...again. What they don't know is that I won't be regaining it this time. I'm gonna trick them..I'm gonna trick them...nannie nannie boo boo.

My heart goes out to you. I'm facing the same thing. "Not medically necessary." I guess they'd rather pay for the diabetes and heart bypass that I'll need in 10 years. I wonder which is cheaper? What gets me (and I'm sure you too) is that I've had 2 doctors that have examined me and said yes. And some insurance clerk that has never laid eyes on me saying "not medically necessary." Maybe I should go sit on her(if she survived) and see if she changes her mind. I haven't written an appeal letter yet. Let me know if you find out anything.

I might be seeking their assistance soon. I got a denial letter yesterday from my insurance company. See round 1 thread for discussion.

They said that it was a predetermination for medical necessity for gastric bypass. Guess what, I couldn't agree with them more that I don't need gastric bypass. That's not what this was about...bunch of dummies! The letter said that the requested service is not "medically necessary." Gastric bypass is not medically necessary or requested for that matter. I'm going to find out what is going on tomorrow when they open. Thanks for the support guys. I'm going to need it.

I live in Nashville. I'm still in the process of trying to get the band. I moved from Memphis. I know that there are docs there that do the procedure...I don't know if they will fill you since you had it done in Mexico. It raises liability issues for them. I, too, would like to see more activity through this Tennessee thread...but not many people visit. Good luck in your search and new life. -
I am so sorry for these people. As a nurse and a mother, it just breaks my heart to see the suffering. However, I agree with mousecrazy and Kathy. There, I said it....shoot me. Thank you Kathy and mousecrazy for having the courage to go against what appears to be the status quo. Action-not excuses will get them through this. May God have mercy on us all.

Seems like when you lose weight, you feel like you can take on the world. That's how I've felt in the past (waiting on the band). Next to losing weight, everything else in life is a walk in the park. Not to poo poo your gpa. THAT'S SO SO AWESOME!!! You go girl!!!!

I'm a telemetry nurse. I saw that other thread about jobs. Lots of fat nurses. My theory is that we take care of others but not ourselves. I'm glad we're finally taking charge of our own health.

Boy, there's a bunch of fat nurses. I'm one too. Takes one to know one. Looks like we're too busy caring for others instead of taking care of ourselves. I'm glad all of us are finally taking charge of our own health.
