Getting insurance to cover Lap Band procedure

I am new to this and wanted to ask if anyone else has had issues with getting your insurance to cover your Lap Band procedure? I have Blue Cross and when I took out coverage 8 years ago, they made me sign a "waiver" on weight loss. I've had a consultation with a Bariatric Clinic to have the lap band done but found today that they denied me due to the waiver on my policy. Did any of you run into this same issue and can you offer me any information on what I can do to get this passed thru. I am a severe morbid obese person with a BMI of 52 and I am starting to incur health issues, so I desperatly want the surgery and have wanted it for the past 4 years. I've researched it mothatically and am ready but my bubble got burst today with this news. A:confused::frown:ny help would be appreciated.

As far as I know if you signed a "waiver" that means that the surgery is excluded, ie not covered. It is not a covered item. You'll need to self pay, I'm thinking

My husband and I are wondering if it is also a form of Discrimination that BCBS did by making me sign the form or not covering me and wonder if legal consel would be worth checking into?
